HEATHROW Airport catering firm Do & Co faces legal proceedings over a Tupe transfer row, Unite said today.

The firm claims that two contracts for Air India flights it has won from Dnata are for sufficiently different services so laws protecting transferring staff’s pay and conditions do not apply, according to the union.

Unite was in the process of pursuing collective legal proceedings against the firm’s refusal to transfer 117 employees when a second Dnata contract was taken over by Do & Co in June.

The union says Do & Co has continued to refuse to engage with it regarding the resulting additional Tupe transfer of 44 employees due in September.

Unite general secretary Sharon Graham said: “The behaviour of Do & Co has been nothing short of disgraceful. While Unite is taking legal action, it has decided to put the jobs of more of our members at risk.”
