A TAMIL who was interrogated and beaten by Sri Lankan authorities won an appeal yesterday against the rejection of his asylum claim.

The man, referred to as ME, became involved with the Tamil Tigers in 2005 while working in a shop, before starting to help hide arms from the Sri Lankan army.

He left the militants in 2007 and lived in Sri Lanka “without incident” until 2014, when he was detained and beaten until he revealed the location of an arms cache.

ME fled for Britain, but his claim for protection on asylum or humanitarian grounds was rejected by the first-tier tribunal and upheld by the upper tribunal.

But the Court of Appeal ruled the tribunals had made an error of law in finding that there was not a “real risk” ME would again be detained and tortured if returned to Sri Lanka.

Lord Justice Lewison remitted ME’s case back to the first-tier tribunal to rehear his appeal against the Home Office.
